STANDARD TERMS & CONDITIONS FOR SUPPLY OF GOODS & SERVICES OF OCEAN YACHT EUIPMENT LTD
1 DEFINITIONS
In this document the following words shall have the following meanings:
1.1 "Consumer" Shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
1.2 “Customer” means any person who purchases Goods and Services from the Supplier;
1.3 “Goods” means the articles specified in the Proposal;
1.4 “Proposal” means a statement of work, quotation or other similar document describing the Goods and Services to be provided by the Supplier;
1.5 “Services” means the services specified in the Proposal;
1.6 “Supplier” means Ocean Yacht Equipment Limited, Unit 19 - 20 Broadfield Park, Seaview Road, Isle of Wight PO31 7US
1.7 “Terms and Conditions” means the terms and conditions agreed in writing by the Supplier.

2 GENERAL
2.1 These Terms and Conditions shall apply to all contracts for the supply of Goods and Services by the Supplier to the Customer and shall prevail over any other documentation or communication from the Customer.
2.2 Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Supplier.
2.3 Nothing in these Terms and Conditions shall prejudice any condition or warranty, expres or implied, or any legal remedy to which the Supplier may be entitled in relation to the Goods and Services, by virtue of any statute, law or regulation.
2.4 Nothing in these terms & Conditions shall affect the Customer’s statutory rights as a Consumer.

2.3 Nothing in these Terms and Conditions shall prejudice any condition or warranty, expres or implied, or any legal remedy to which the Supplier may be entitled in relation to the Goods and Services, by virtue of any statute, law or regulation.
2.4 Nothing in these terms & Conditions shall affect the Customer’s statutory rights as a Consumer.
3 THE ORDER
3.1 The Customer shall be deemed to have accepted the Proposal by placing an order with the Suppler.
3.2 All orders for Goods and Services hall be deemed to be acceptance of the Proposal pursuant to these Terms and Conditions.

4 PRICE AND PAYMENT
4.1 The price for the Goods and Services is as specified in the Proposal and is inclusive of VAT and any applicable charges outlined in the Proposal.

No Fault Returns.
You are entitled to withdraw from this contract within 7 days from delivery of the goods for a full credit or refund less any applicable delivery charges. The goods must be unopened and ‘as new’ in their original box and packaging including all manuals and accessories. You must notify us within 7 days from date of delivery. Goods received back in any condition other than ‘as new’ will be returned back to you. Please note it is your responsibility to ensure that the goods you order are specified to meet your intended purpose.
Faulty Returns
In the instance of an item being deemed faulty, please contact us within 7 days from the delivery date. You can then return the faulty item directly yourself. Upon receipt of the goods and confirmation of the fault by our technical engineers you will be offered the following options:
1. A replacement – this item will be shipped to you at our own expense.
2. A repair – the repaired item will be shipped to you at our own expense. Please note that once repaired the product is no longer eligible for replacement.
3. A full refund – provided the item has been verified faulty and is complete with all accessories in its original box and packaging. If the product is not deemed to be faulty by our technicians then you will be offered the following options:
1. Return of the goods – the cost of delivery charged to you.
2. Refund – the invoice cost less any applicable delivery charges provided the product is ‘as new’ and complete with all accessories in its original box and packaging. If the condition of the product or the packaging is poor then we reserve the right to impose a charge to cover re-packaging costs. Missing accessories will also be charged to you. The manufacturers guarantee will apply to all items reported to be faulty after 7 days from delivery. This returns policy does not affect your legal rights.
